Introduction
These Terms and Conditions set out the basis on which Motors Recovery provides vehicle breakdown recovery, towing and related services, and the terms on which you may use this website. Please read them carefully before booking any service or using our site.

By requesting or accepting any recovery or related services from us, or by continuing to use this website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services or this website.

These terms are intended to be clear and easy to understand. They do not affect any rights you may have under applicable consumer protection laws. For information on how we collect and use your personal data, please refer to our Privacy Policy.

In these Terms and Conditions, the following expressions have the meanings set out below. These definitions are provided to help you understand the scope of our services and your agreement with us.

VehicleThe car, van, motorcycle or other vehicle in respect of which services are requested and which falls within the size and weight limits we specify.

ContractThe agreement between you and us for the provision of services, incorporating these Terms and Conditions and any price or service details agreed at the time of booking.
Booking & Acceptance of Services
You can request services by calling our advertised telephone numbers or, where available, by submitting an online enquiry. A booking is made when you provide us with the necessary details and we confirm that we are able to attend, either verbally or in writing.

Our confirmation of attendance (including any estimated arrival time and price) constitutes our acceptance of your booking and the creation of a Contract between you and us, subject to these terms. We may decline a booking at our discretion, for example where your vehicle does not meet our operating limits, where access is unsafe, or where we have no availability.

Any estimated arrival times are our best reasonable estimates and are not guaranteed. Traffic conditions, weather, road closures and other factors outside our control may affect how quickly we can reach you, but we will always use reasonable efforts to arrive as soon as possible.

If you book on behalf of another person (for example, a driver of a company vehicle), you confirm that you are authorised to do so and that the driver and/or vehicle owner agrees to these Terms and Conditions.
Scope of Services
Motors Recovery provides pay-as-you-go breakdown recovery, towing, roadside assistance, accident recovery, police pound recovery, scrap vehicle collection and related services within Greater London and surrounding areas, as advertised on our Site.

Our services are generally available for cars, vans, motorcycles and similar vehicles within the size and weight limits of our equipment and any applicable road or legal restrictions. We reserve the right to refuse or suspend services if your vehicle exceeds these limits, is unsafe to move, or if doing so would breach applicable laws or regulations.

Unless specifically agreed, our services do not include mechanical repairs, parts replacement or diagnostics beyond basic roadside assistance aimed at moving your vehicle to a safe location or agreed destination. We may, at our discretion, offer limited assistance such as battery jump-starts, fitting a spare wheel or providing a small quantity of fuel to enable you to reach the nearest fuel station.

We may subcontract all or part of a Job to carefully selected third-party recovery operators. Where we do so, we remain responsible for the overall performance of the Contract with you, but the third-party operator will be responsible for the safe and lawful operation of its own vehicles and staff.
Customer Responsibilities
You are responsible for providing accurate and complete information when requesting our services, including your name, contact details, exact vehicle location, destination, vehicle type, registration mark and any known issues with the vehicle.

You must ensure that you, your passengers and any pets are safe while waiting for assistance, following all relevant highway codes and official guidance. Where possible, move to a safe place away from traffic, use hazard warning lights and any warning devices you have available, and follow any safety instructions given by our team.

You must ensure that the vehicle is accessible to our recovery vehicle and that any necessary authorisations (for example, from the police pound, car park operator or landowner) are in place. If we are delayed or unable to complete a Job because access has not been arranged, waiting time and/or additional charges may apply.

You are responsible for removing, securing or supervising any personal belongings in the vehicle. We are not responsible for loss of or damage to personal items left in the vehicle during recovery, transport or storage unless caused by our negligence.

You agree to follow any reasonable instructions given by our driver or operator at the scene, particularly where they relate to your safety or the safe loading, securing and unloading of your vehicle.
Pricing, Payment & Cancellations
Our services are provided on a pay-as-you-go basis. Unless otherwise stated, any prices we quote are for the specific Job described at the time of booking and are based on factors such as vehicle type, location, destination, distance, time of day and any special requirements.

We will inform you of the price, or how the price will be calculated, before you agree to proceed. By confirming your booking, you agree to pay the agreed charges, including any waiting time, additional mileage, tolls, congestion or emission charges and parking fees that apply.

Unless we agree otherwise in advance, payment is due immediately on completion of the Job and must be made by one of the payment methods we accept at that time. We reserve the right to require full or partial payment in advance, particularly for long-distance recoveries or special services.

You may cancel Your Recovery / Roadside Assistance request within 5 minutes at no cost. If more than 5 minutes have elapsed after the Service Provider has been dispatched and before their arrival, we reserve the right to charge you a Cancellation Fee of £50.00 – £250.00, depending on the requested services.

The remaining balance will be refunded minus any charges incurred (admin fee, Driver Call Out payment, mileage, ulez, congestion charge/toll etc.) as long as we have not reached you beforehand.

You will be charged the FULL amount of the quoted service price when the Service Provider arrives at the Location, and you cancel for any reason at that time, or you are not at the Location; the Service Provider determines that you have inaccurately stated the condition of Your Vehicle or the problem with the Vehicle where the service cost may be higher than initially quoted, and You cancel Your Recovery / Roadside Assistance request.
ItemSummary
Call-out chargePayable for each Job once a driver has been dispatched, even if your vehicle is moved or repaired before we arrive.
Waiting timeMay be charged if our driver is kept waiting beyond a reasonable period due to access issues, incomplete paperwork or delays outside our control.
Additional mileageRecovery beyond the distance originally agreed may be charged at an additional per-mile rate.
Tolls, congestion and similar chargesAny tolls, congestion, emission or parking charges incurred in completing the Job may be added to your final bill.
Cancellation before dispatchGenerally no fee, but we reserve the right to charge a reasonable administration fee in certain circumstances.
Cancellation after dispatchA cancellation fee and/or the full call-out charge may apply if you cancel after our driver has been dispatched.
Non-paymentWe may retain possession of the vehicle until payment is received in full and may take legal action to recover unpaid sums.
Liability & Limitations
We will carry out our services with reasonable skill and care, using appropriately maintained vehicles and equipment. If we fail to do so, you may be entitled to a repair, re-performance or compensation in accordance with your legal rights and these Terms and Conditions.

We are not liable for any loss or damage arising from inaccurate information you provide, failure to follow our instructions, or circumstances outside our reasonable control (such as traffic delays, weather conditions, road closures or third-party actions).

We are not liable for any indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of use of the vehicle, even if we have been advised of the possibility of such losses. We are also not responsible for any deterioration in the condition of your vehicle that results from the underlying fault, accident damage or existing defects.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

Subject to the above, and to the extent permitted by law, our total liability in respect of any single Job is limited to the lesser of: (a) the cost of re-performing the services; or (b) the total amount paid or payable by you for that Job.
Events Outside Our Control
We will not be in breach of these Terms and Conditions, nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control.

Such events may include, but are not limited to, severe weather, flooding, fire, accidents, road closures, traffic congestion, public disorder, industrial action, acts of terrorism, war, pandemics, fuel shortages, breakdown of our own vehicles, or failure of third-party networks, systems or services.

Where such an event occurs, we will take reasonable steps to minimise its impact on you and to resume or complete the services as soon as reasonably practicable. If a delay is likely to be significant, we will, where possible, inform you and give you the option to cancel the Job without additional charge.
Website Use & Intellectual Property
All content on this Site, including text, images, logos, graphics, icons and layout, is owned by or licensed to Motors Recovery and is protected by copyright, trade mark and other intellectual property laws. You may view, download and print content for your own personal, non-commercial use only.

You must not copy, reproduce, modify, distribute, display, sell or otherwise use any part of the Site or its content for commercial purposes without our prior written consent. You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.

You agree not to attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack.

Our Site may contain links to third-party websites. These links are provided for your convenience only and do not constitute our endorsement of those sites or their content. We have no control over, and are not responsible for, the content, privacy policies or practices of any third-party websites. Your use of such sites is at your own risk.

The information on this Site is provided for general information purposes only and does not constitute professional advice. While we use reasonable efforts to keep the content up to date and accurate, we make no representations, warranties or guarantees, whether express or implied, that the information on the Site is complete, accurate or current.
Complaints & Dispute Resolution
We aim to provide a professional, reliable and helpful service at all times. If you are unhappy with any aspect of our services, please contact us as soon as possible so that we can try to resolve the issue.

You can raise a complaint by emailing us at info@motorsrecovery.co.uk. Please provide your name, contact details, Job details (including date, time and location) and a clear description of your concerns.

We will acknowledge your complaint, investigate what has happened and respond to you with our findings and any proposed resolution within a reasonable timeframe. Where appropriate, we may offer a remedy such as an explanation, apology, corrective action or, where justified, a partial or full refund.

If we are unable to resolve a dispute informally, you may have the right to refer the matter to an alternative dispute resolution body or to pursue your claim through the courts. Nothing in these terms affects your statutory rights.
Governing Law & Jurisdiction
These Terms and Conditions, and any Contract between you and Motors Recovery, are governed by and shall be construed in accordance with the laws of England and Wales.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions, the Contract, or the provision of our services, except where you are a consumer resident in another part of the United Kingdom and the law gives you the right to bring proceedings in your local courts.
Changes to These Terms
We may update or amend these Terms and Conditions from time to time, for example to reflect changes in our services, our operating practices or applicable laws and regulations. When we do so, we will post the updated version on this Site and update the "Last updated" date below.

Any changes will apply to new Jobs and to use of the Site from the date the updated terms are posted. We recommend that you review this page regularly to ensure that you are aware of the current terms that apply to you.
